주거용 부동산 (단독주택, 타운하우스, 아파트 또는 콘도) 구매하기

1.  리얼터(부동산 중개사) 선정하기

먼저 주택을 구매하고자 하는 지역 전문 리얼터를 선정하는 것이 중요합니다.  리얼터는 주택의 검색 과정부터 구매의 마지막 과정까지 고객의 이익을 위해서 일할 수 있는 전문성과 성실함을 지녀야 합니다. 참고로 밴쿠버에서는 한국과는 달리 구매자의 리얼터 수수료도 주택을 판매하는 사람이 지급하도록 되어있습니다. 

2. 주택 검색 보여주기

리얼터를 통하여 MLS에서 원하는 조건에 적합한 매물을 검색하도록 하고, 관심 있는 주택 매물을 찾으면 방문해서 볼 수 있도록 합니다.

3. 오퍼 작성하기

마음에 드는 주택을 찾은 경우 리얼터와 함께 오퍼(Contract of purchase and sale : 흔히  offer라고 표현)를 작성해서 판매자 측에 제출합니다. 오퍼를 통해서 주택의 구매 가격과 입주 날짜 (잔금을 지불하는 날짜: completion date) 및 기타 일반적인 조건(subjects) 등을 제시합니다. 일반적인 조건은 아래와 같습니다.

 - 주택 구매를 위한 은행 융자(주택모기지) 승인 받기

 - 주택 등기부 등본(Title Search) 확인하기

 - 주택의 상태를 점검하기 위한 인스펙션하기

 - 주택의 설명서와 같은 PDS(Property Disclosure Statement) 검토하기

 - 아파트, 콘도, 타운하우스 같은 공동 주택의 경우 관련서류 검토하기

협상 과정을 통해서 오퍼가 양 측에 받아들여 진 다음 위와 같은 조건들을 확인하고 해지하기까지 일반적으로 오퍼가 받아들여 진 순간부터 5-7 business day를 요구합니다. 제반 조건을 점검하고 조건을 해지(subject removal)하게 되면 법적으로 매매 계약이 성립 (firm deal)되고, 조건 해지 후 24-48 시간 안 에 집 값의 5% 정도를 계약금으로 집을 사는 리얼터 회사의 신탁계좌에 예치합니다. 일반적으로 잔금을 지불하는 completion date는 조건 해지 후 한 달에서 두 달 이후로 합니다. 

4. 잔금 지불 등기 이전하기

캐나다에서는 주택 매매 시 반드시 변호사나, 공증사가 등기 이전을 하도록 되어있습니다. 따라서 매매에 관련된 모든 서류와 사항들을 변호사나 공증사가 사전에 확인한 후 오퍼에서 합의한 잔금 지불 날짜에 매매에 관련된 비용을 정산하고 등기 이전이 이루어지게 됩니다. 집을 사는 사람은 등기 이전과 동시에 구매하는 주택에 대한 보험을 가입하도록 합니다. 

5. 입주하기

일반적으로 등기가 이전된 completion date하루 또는 이틀 후에 입주하게 되는데 이 날을 possession date 및 adjustment date라고 합니다. 이 날 집의 열쇠를 받고 실질적으로 집의 소유자가 됩니다.

 

주거용 부동산 구매 비용

1. 부동산 취득세

취득세(Property purchase tax) : 주택 취득 시에 내시는 유일한 세금으로 집 값의 첫 $200,000 까지는 1%, 나머지 금액에 대해서는 2%를 내시면 됩니다. 예를 들어서 $1,000,000 집을 사시면 $18,000을 취득세로 내시면 됩니다.

2. 변호사 또는 공증사 비용

변호사 또는 공증사 비용(legal fee)은 소유권 등기 이전 및 주택 구매에 관련된 업무를 대행해주는 변호사 또는 공증사에게 지불하는 비용입니다.

3. 인스펙션 비용  

콘도, 타운하우스, 특히 단독 주택을 구입할 경우 라이선스가 있는 전문home inspector를 고용해서 인스펙션을 하는 것이 좋습니다.

Your first step to buying a home is to first ask yourself why you want to buy a home: to stop paying rent? To start building equity? To have a place of your own? To raise a family? To entertain business associates? To move up to a bigger house? Next, list what kind of home you'd like and where you would like to be. Be specific. Separate the "must haves" from the "want to haves."

Think of yourself as zeroing in on a target, going from the general to the specific. Consider area (city, suburban neighborhood, country); community (north, south, east, or west side); neighborhood (older and settled or sparkling new; a particular school zone; recreational facilities; and other community services such as transportation, day care, library, stores, entertainment). Ask yourself how many minutes you are willing to commute to work.

Think about home styles. How much space do you need? Does your situation require a one-level home, or are stairs acceptable? Consider size and kind of property. Do you want a newer home, or maybe an older one to fix up? Someday you or your heirs will want to sell. Consider how long you expect to live in this particular home.
